Business Agreement
This agreement covers what it means to run a business account on Twizted Liftz: the insurance you must carry, the liability you keep, and the indemnity you give us. It applies in addition to the general Terms of Service.
1. Who this agreement is between
This Business Agreement is between you — the rental shop, dealership or tour operator operating a business account on Twizted Liftz — and Twizted Chefs LLC, the Massachusetts limited liability company that operates Twizted Liftz. It sits alongside, and takes priority over, the general rider Terms of Service wherever the two disagree.
By signing it you confirm you are authorised to bind the business you have registered, and that everything you have told us about it is true.
2. What Twizted Liftz is, and is not
Twizted Liftz is a marketplace and an advertising platform. We introduce riders to businesses and take payment on your behalf. We are not the owner of your vehicles, we are not the rental company, and we are not a party to the rental agreement between you and the rider.
We do not inspect, service, maintain, store, deliver or take possession of any vehicle listed by a business. Every decision about what you rent out, to whom, and in what condition, is yours alone.
3. Your obligations
- —Keep every vehicle you list roadworthy, legally registered and safe for the rider to use.
- —Describe each vehicle accurately, including its engine size, so the right license class is required.
- —Comply with every law that applies to you, including consumer protection, rental, tax and vehicle-safety law in the state you operate in.
- —Tell us immediately if your registration, insurance or right to operate changes.
- —Only rent to riders whose license Twizted Liftz has approved. Never bypass that check.
4. Insurance — mandatory
You must hold current commercial or business liability insurance that covers renting out the vehicles you list, and you must give us your carrier, policy number and expiry date before your page can go live.
We check that date every time your page is saved. If your policy expires and you have not given us a renewal, your business page and your listings are taken offline automatically until cover is back in place.
You agree that your insurance is the primary cover for anything that happens during a rental you arranged. Twizted Liftz is not your insurer and does not provide cover for your business, your vehicles or your staff.
5. Liability and indemnity
You are liable for your own vehicles, your own premises, your own staff and your own conduct. This includes loss of or damage to a vehicle during a rental you arranged, and any injury or loss suffered by a rider or a third party arising out of your vehicle, your maintenance, your instructions or your failure to comply with this agreement.
You agree to indemnify and hold harmless Twizted Liftz, its owners, officers and staff against any claim, demand, loss, damage, fine or legal cost arising out of: a vehicle you listed; your breach of this agreement; your breach of any law; anything you told us that was untrue; or any act or omission of you or your staff.
This indemnity does not apply to the extent a claim was caused by Twizted Liftz's own gross negligence or wilful misconduct.
6. If a rider or a third party is hurt or property is damaged
Report any accident, injury or damage to us within 24 hours using the in-app accident reporting flow, and co-operate fully with any investigation.
You must notify your insurer yourself. Twizted Liftz will not submit a claim on your behalf, and does not promise that any claim will be accepted or paid.
Where a rider causes damage to your vehicle, you keep the right to pursue that rider directly. Twizted Liftz may help put you in touch, but is not obliged to pay, recover or guarantee any amount.
7. Subscription, fees and cancellation
A business account is a paid monthly subscription, charged in advance and renewing automatically until you cancel. The current price is shown to you before you subscribe.
Cancelling stops future renewals. Your business page goes offline when the subscription ends, and the verified badge, directory priority and unlimited listings go with it. Your listings themselves are not deleted.
We may change the subscription price with reasonable notice. Continuing to subscribe after a price change means you accept it.
8. Verification, suspension and removal
We may ask for evidence of your registration, your insurance or your authority to operate, and may suspend or remove your business page if we are not satisfied, if a document expires, or if we receive credible complaints.
We may remove any listing that is unsafe, misleading, unlawful or that damages the marketplace, without refunding subscription fees already paid.
9. Term and governing law
This agreement starts when you sign it and continues while you hold a business account, and survives the end of your account for anything that happened while it was running.
It is governed by the laws of the Commonwealth of Massachusetts, and the courts of Massachusetts have exclusive jurisdiction over any dispute arising from it.
