Terms of Service
The rules for using Twizted Liftz — what the marketplace is, what owners and riders each agree to, and how bookings, payments and damage are handled.
1. Your agreement with us
Twizted Liftz is operated by Twizted Chefs LLC, a Massachusetts limited liability company. Twizted Chefs LLC is the party you are contracting with under these terms, and "we", "us" and "our" mean Twizted Chefs LLC.
By creating an account or booking a ride on Twizted Liftz, you agree to these terms. If you do not agree with them, please do not use the app.
You must also follow the rules that apply to the ride itself — the Massachusetts moped laws summarised in the app, and any local ordinances that are stricter.
2. What Twizted Liftz is — and what it isn't
- —Twizted Liftz is a marketplace. We connect riders with owners who list their own vehicles, and we handle the booking and the payment between them.
- —We are not the owner of any vehicle listed here, we are not a rental company, and we do not hold, store or maintain the vehicles.
- —The agreement to rent a vehicle is between the rider and the owner. The owner is responsible for the vehicle; the rider is responsible for riding it lawfully and returning it as agreed.
- —We are not a party to that rental agreement, but we do take responsibility for damage under section 7 below.
3. Accounts
- —You need an account to book a ride, list a ride or leave a review.
- —Give accurate information and keep it up to date — especially your phone number, which is how an owner reaches you about a handover.
- —You are responsible for what happens under your account. Keep your password to yourself and tell us if you think it has been compromised.
- —One person, one account. Do not share an account or create one on someone else's behalf.
4. Who may ride
- —You must be at least 16 to hold an account and to book a moped, scooter or e-bike.
- —Riders aged 14 and 15 may book E-Bikes and Scooters only, and only through a parent or legal guardian who signs the Minor Rider Waiver and provides their own photo ID.
- —No one under 16 may operate a moped. This is state law and we enforce it.
- —To book a moped you must hold a valid driver's license or learner's permit.
- —You must hold a valid license or permit for the vehicle you are riding, and you must be the person who booked it. Do not let anyone else ride a vehicle you booked.
- —Helmets are required for the rider and any passenger on every moped booking.
5. Listing a ride
- —You must own the vehicle you list, or have the owner's authority to list it.
- —Listings must be accurate: the right category, a fair daily price, real photos, and a description that does not overstate what the vehicle can do.
- —Your vehicle must be roadworthy, registered and insured as required by law, and in the condition your listing describes.
- —A vehicle whose restrictor plate has been removed is legally a motorcycle in Massachusetts, and cannot be listed on Twizted Liftz.
- —You must honour bookings you accept, hand the vehicle over charged and ready, and respond to riders promptly.
- —You are responsible for the accuracy of anything you write in a listing, and you may not list a vehicle you are not permitted to rent out.
6. Booking and payment
- —The total price of a booking is calculated by the platform from the vehicle's daily rate and your rental dates. The price you are shown at checkout is the price you pay.
- —Rentals are paid by card through our payment processor. Cash, bank transfer and off-platform payment are not permitted for a booking made here.
- —A booking is not confirmed until payment has been taken.
- —The owner receives their share after the rental. The platform's fee is taken from the booking total.
- —Do not agree a separate price with an owner outside the app. It removes your protection under section 7 and may get your account suspended.
7. Damage, loss and theft
- —Take the before and after photos the app asks for, on every rental. They are the record of the vehicle's condition and they protect both sides.
- —Twizted Liftz accepts financial responsibility for damage to a vehicle that happens during a booking, subject to the Damage Policy in the app.
- —We reserve the right to seek reimbursement from a rider where the damage was caused by misuse, riding outside the law, letting someone else ride, or a breach of these terms.
- —Report damage, a breakdown or a theft immediately, and co-operate with the investigation.
8. Cancellations and refunds
- —You can cancel a booking from your Bookings page. What you get back depends on how close to the pickup you cancel and is set out in the Damage Policy and the booking flow.
- —If an owner cancels, you are refunded in full.
- —If a vehicle is not as described or is not fit to ride, tell us before you ride it. Do not ride an unsafe vehicle.
- —Refunds go back to the card you paid with and can take a few business days to appear.
9. Availability alerts and the waitlist
- —If a ride is already booked for your dates, you can ask to be emailed if it opens up.
- —We send that email as a courtesy, in the order requests were received. It is not a reservation and it does not hold the dates.
- —If someone else books first, the dates are gone.
10. Reviews
- —Reviews must be about a rental you actually completed, and must be honest.
- —No threats, harassment, slurs, personal information about another person, or content that is not yours to publish.
- —We may remove a review that breaks these rules.
11. Acceptable use
- —Do not use the app to break the law, to ride without a license, or to rent a vehicle you are not eligible for.
- —Do not sublet, resell or lend a vehicle you have booked.
- —Do not ride under the influence, race, or use a vehicle for delivery or commercial work unless the owner has agreed in writing.
- —Do not scrape the app, probe its security, or attempt to access another person's account or documents.
- —Do not post false information, impersonate anyone, or create listings for vehicles that do not exist.
12. Suspending or closing an account
- —You can delete your account at any time from your Account page.
- —We may suspend or close an account that breaks these terms, puts someone at risk, or is used to commit fraud — and we may cancel bookings attached to it.
- —We may also remove a listing that is inaccurate, unsafe or unlawful.
- —Records we must keep for tax, accounting or dispute purposes survive account deletion.
13. Disclaimers and limits on our liability
Twizted Liftz is a marketplace and does not own, inspect or maintain the vehicles listed on it. We do not promise that a listing is accurate, that an owner will perform, or that a vehicle is roadworthy — but we do act on reports, and section 7 sets out our responsibility for damage during a booking.
To the fullest extent the law allows, we are not liable for indirect or consequential losses, for a rider's own riding, or for anything an owner and a rider agree between themselves outside the app. Nothing in these terms limits liability that cannot lawfully be limited.
14. Changes to these terms
We may update these terms as the app changes. The date at the bottom of this page shows when they were last revised. If a change is significant, we will tell you in the app or by email before it takes effect, and continuing to use Twizted Liftz after that means you accept the updated terms.
