Damage Policy

This policy explains how damage to a ride is handled on Twizted Liftz: what the rider is responsible for, how the owner is made whole, and how Twizted Liftz recovers what it pays out. It applies to every booking made through the platform. Riders who damage, keep, or fraudulently obtain a ride will be held responsible — financially, and criminally where the facts support it.

1. Who this policy covers

  • —Owner — the person who lists a ride on Twizted Liftz.
  • —Rider — the person who books a ride and takes possession of it for the booking window.
  • —Platform — Twizted Liftz, operated by Twizted Chefs LLC, which connects owners and riders. The platform does not own, store, inspect, or operate any ride listed on it.
  • —Damage — any loss, breakage, theft, vandalism, missing part or accessory, or any other harm to a ride that goes beyond normal wear and tear.

2. The rider is responsible for the ride

The rider is responsible for the ride from the moment of handoff until the owner confirms its return at the end of the booking.

Accepting this policy at checkout is the rider's agreement that they will be held fully responsible for that ride. Returning it damaged and unreported, keeping it past the return time, or letting someone else use it is a breach of that agreement, and Twizted Liftz will hold the rider accountable for it.

  • —The rider agrees to pay for all damage, theft, loss, missing accessories, parking and traffic violations, towing, and impound fees that occur during their booking.
  • —The rider also agrees to pay for the owner's loss of use — the rental income the owner loses while the ride is being repaired.
  • —This responsibility is not limited by any deposit, deductible, or cap.
  • —The rider confirms that only the person named on the booking will operate the ride, and that the ride will not be used for any commercial purpose unless the owner agreed to it in writing.
  • —Keeping a ride past its return time, abandoning it, or refusing to hand it back may be treated as theft and will be reported to law enforcement.

3. Twizted Liftz pays the owner upfront

When damage is reported and documented as described in section 5, Twizted Liftz will pay the owner for the covered damage upfront, based on repair estimates or paid invoices.

Paying the owner does not release the rider. It transfers the rider's obligation to Twizted Liftz, and Twizted Liftz steps into the owner's place to recover the full amount.

  • —Twizted Liftz will pursue the rider for every amount it pays out, plus related costs.
  • —Recovery may include direct charges, collection activity, and legal action.
  • —A payment from Twizted Liftz is not insurance and does not limit the rider's liability in any way.

4. How the owner is protected

  • —The owner is held harmless for damage caused by a rider during a booking.
  • —The owner is not expected to negotiate with the rider, chase payment, or bring a claim on their own.
  • —The owner keeps ownership of the ride at all times — Twizted Liftz never takes title to, or responsibility for, a listed ride.
  • —So that recovery rights stay intact, the owner agrees not to settle directly with a rider over covered damage without written agreement from Twizted Liftz.
  • —If the owner is paid by a rider, an insurer, or anyone else for the same damage, the owner will tell Twizted Liftz so the amounts can be reconciled.

5. Reporting damage

  • —Report damage within 24 hours of the ride being returned, with photos and a written description.
  • —Condition photos taken at handoff and at return are the primary evidence of a ride's condition.
  • —Twizted Liftz may ask for a repair estimate, an invoice, or a police report before paying a claim.
  • —Claims reported late, or without documentation, may be reduced or declined.

6. What is not covered

  • —Normal wear and tear.
  • —Mechanical failure that was not caused by the rider.
  • —Damage that existed at handoff and is visible in the handoff photos.
  • —Damage from a ride that was already unsafe or defective when it was handed over.
  • —Anything that happened outside the booking window.
  • —Rides used by someone other than the booked rider, or for an unlisted commercial purpose.

7. Claims and cooperation

Twizted Liftz decides the amount of a claim based on the documentation provided, and may decline a claim that is not documented. That decision settles the matter between Twizted Liftz and the owner only — it does not determine what the rider owes.

The rider and the owner agree to cooperate with Twizted Liftz by providing statements, photos, receipts, insurance details, and police reports, and by making themselves available if a claim goes to court.

8. Reimbursement, legal recovery, and criminal referrals

  • —The rider agrees to reimburse Twizted Liftz in full within 30 days of a written demand.
  • —Twizted Liftz will report theft, unauthorized use, vandalism, and fraudulent bookings to law enforcement and will cooperate fully with any investigation.
  • —Twizted Liftz will support the prosecution of any rider who steals, keeps, damages, or fraudulently books a ride, and will provide the evidence, records, and testimony needed to do so.
  • —Criminal charges are filed by law enforcement and prosecutors, not by Twizted Liftz. Twizted Liftz will press for charges whenever the facts support them.
  • —A criminal case does not reduce what the rider owes. Twizted Liftz will still recover every amount it paid out.
  • —Amounts that are not paid on time may be referred to a collection agency.
  • —Where the law allows, overdue amounts may carry late fees, interest, and the costs of recovery.
  • —Twizted Liftz may bring legal action to recover what it paid, and the rider agrees to pay reasonable attorney fees and court costs where the law allows.
  • —Nothing in this policy waives any right or remedy available to Twizted Liftz or to an owner, and all rights are expressly reserved.

9. Changes and questions

  • —Twizted Liftz may update this policy. The version in effect on the day a booking is made applies to that booking.
  • —Questions about a claim can be sent to Twizted Liftz through the support contact on your account page.
